How Long Does Probate Take?

In California, probate takes approximately seven to ten months from the date of filing the probate petition. Complications can make the process take longer. Talk to a probate law attorney about your specific circumstances. Call the Coggins & Johnston law firm in Rocklin, California.

Probate Law Attorney
It can be difficult to deal with the exacting and often emotional issues of probate after a loved one dies. Working with the right probate law attorney will help make this emotionally difficult time easier. Below you will see a general outline of the time line for a basic probate.

  • Within 20 days: File the initial probate documents and the will (if there is a will)
  • After 45 days: At a court hearing, a personal representative will be appointed
  • For four months: Creditors have this opportunity to file claims against the estate
  • After 5 and a half months: A final accounting should be prepared and filed with the court
  • At 6 and a half to 7 months: Disbursements can be made to the heirs and creditors and the estate can be closed.

An abbreviated probate (a shorter time frame) is possible under certain circumstances.

To assure that all relevant materials are gathered, that all bills are paid, and that the disbursements are made properly and in a timely fashion, contact a lawyer who has experience with California probate courts. Talk to your lawyer about probate costs and fees.

When you need a probate law attorney with a solid foundation of experience, a sincere interest in helping you, and an in-depth understanding of the law, contact the Coggins & Johnston law firm. There is no charge for the initial consultation.
