What Does Probate Cost?

    A probate lawyer's fees are set by statute at 4% for the first $100,000 of estate value, 3% for the second $100,000, 2% of the next $800,000, 1 % of the next $9 million, and 1/2% of the next $15 million.
  • Probate court filing fees
    Filing fees range from $320 for an estate valued at under $250,000 to $3,635 for a $3.5 million estate.
  • Probate court costs and fees
    Probate often has additional costs and fees ranging from $700 to $2,000.

In complex probate cases involving lawsuits or tax problems, the probate court can increase the fees of the probate attorney and other fees to cover increased costs.
