Do You Know Your Rights as a Debtor?

How far can a debt collector go to collect money from you? What a debt collector tells you may not be true. A debt collector does not even have the right to call you if you make a request that the calls cease. If you are fighting harassment by a debt collector, know your rights. Talk to a bankruptcy attorney at Coggins & Johnston law firm in Roseville, California.

Call (916) 797-1397 for a free consultation with a bankruptcy attorney.

The FDCPA assures that consumers have rights against abusive debt collection tactics.
Added in 1978 as part of the Consumer Protection Act, the Fair Debt Collection Practices Act (FDCPA) protects consumers who are being harassed by debt collectors. Be aware that a debt collector is not allowed to call after 9 p.m. or before 8 a.m. The debt collector cannot call your home at all if you make a written request. A verbal request is enough to keep a debt collector from calling you at work.

Know that threats and misstatements are against the law.
Threatening arrest or legal action is not permissible under the law. If you are represented by a bankruptcy attorney, all calls should be directed to the lawyer and you should not be bothered again. The debt collector cannot use abusive or profane language in trying to collect a debt.
